Update on downtown development — filing in Superior Court

On April 14, Save Downtown Menlo filed a petition for writ of mandate and complaint for declaratory and injunctive relief in the San Mateo County Superior Court. Save Downtown Menlo is listed as an unincorporated association represented by David P. Lanferman and Erik C. Leggio with Rutan & Tucker, LLP. The filing names the City of Menlo Park, the Mayor and City Council. The City has not been served with the lawsuit at this time.

Save Downtown Menlo seeks a writ of mandate for the City to rescind its RFQ seeking proposals for development of three downtown parking lots between Santa Cruz Avenue and Oak Grove Avenue, comply with the Surplus Lands Act, and halt any further work to explore potential development of the downtown parking lots. It also seeks costs of the suit, attorneys’ fees, and other relief the Court deems just and proper.

The City is releasing this information for transparency while it reviews the filing.
